SOUTH AFRICAN FUTURE TRUST AWARDS COMPETITION TERMS AND CONDITIONS RULES AND REGULATIONS
Terms and Conditions
These Rules and Regulations (“Rules”) for the South African Future Trust Awards Competition (the “Competition”) are subject to the Terms and Conditions of Use & Privacy Policy (the “Terms and Conditions”) that govern the websites where information about the South African Future Trust Awards is located. These Terms and Conditions and policies van be found on our website at https://southafricanfuturetrust.org
The Competition is administered by the South African Future Trust registration number IT 634/2020 (defined herein variously as “SAFT”, “South African Future Trust” or “the Trust”). Entry into the competition constitutes acceptance of these Terms and Conditions.
Eligibility Requirements
- The Competition is open to South African citizens operating businesses registered with the Companies and Intellectual Property Commission. (herein defined as “Participants”)
- For eligibility in the Youth category of the Competition, Participants are required to be aged under 35.
- For entry in the Women category of the Competition, the SAFT reserves the right to disqualify any Participant based on its sole discretion.
- Participants will be asked to certify the compliance of their entries with the Rules when entering the Competition, and SAFT reserves the right to verify the validity of information submitted, including but not limited to registration of the business.
- The Rules apply to both Participants and their businesses (where applicable). By entering the Competition, a participant is indicating his/her agreement to be bound by these Rules. The Participant will ensure that his/ her business agrees to be bound and to comply with these Rules.
- The Competition is open to ALL registered businesses operating in South Africa. Staff of the South Africa Future Trust, including Consultants, Interns, stakeholders and partners are not eligible to participate in the Competition.
Submission Rules
- To participate in the Competition, Participants must submit a document outlining a description of the business, and a video introducing the Participant and his/ her business. In addition to the category criteria specific specified for the to the respective categories below, the document must address the key risks that the Participant has taken to build the business, and how the business has innovated within a niche or separately identifiable market segment (herein defined as “Submissions”).
Category specific criteria
a. Youth entrepreneur:
Applicants must be under 35 years old when they enter the competition. The Youth entrant must have a minimum of 50% share in the business.
b. Social entrepreneur
Applicants must specifically evidence how the business has provided solutions to social, cultural or environmental issues.
c. Tech entrepreneur
Applicants must specifically evidence how the business has commercialised emerging technologies.
d. Most innovative idea
Applicants must specifically evidence how innovative methods, ideas or products have been employed in your business.
e. Woman in business
• 51% or more black-owned (broad-based black; South African citizen)
- Trading within South Africa and the majority shareholder be a Black South African citizen
- Total annual revenue less than R50m
- Main applicant needs to be a director with shareholding, and dedicated full-time to the business.
- The business must have a valid B-BBEE certificate with an indicator of at least 51% black-ownership; this cannot be in the form of black-beneficiaries as often the case with NGO’s/NPO’s
f. OOM in action
- How have you applied learnings from the OOM Learning Programme to make a material difference in your business?
- Applicants must have attended the 2024 Summit and be on our attendee list.
- Applicants must have Registered for the OOM Learning Programme.
- Applicants must have completed the OOM Learning Programme.
- Applicants must have submitted all requested updates from South African Future trust.
2.The Submissions are subject to the rules set out herein and must be accompanied with a full set of information as described herein (all together herein defined as an “Entry”) through the Competition online submission form. Entries must comply with the following Submission Rules:
3. Submissions must be created by and owned by the Participants and submitted in English.
4. Submissions shall not be longer than 20 pages, excluding documents provided as evidence supporting compliance with the Rules.
5. An Entry will only be accepted if it includes certified copies of the Participant’s identity document, business registration number, evidence of a bank account and a tax registration number.
6. Should you be successful in advancing to round 2, you must submit to us copies of valid audited financial statements, SARS tax clearance certificate, and the identity documents of all the directors of the business (where applicable.) Failure to submit any required document will result in disqualification.
7. The various categories and specific criteria applicable to each category are detailed in submission rules point 1 above. To the extent that any criterion in point 1 above contradicts any of the Rules, the Rules shall prevail.
8. This competition runs from 22 November 2023. Participants must submit their Entries by 31 May 2024. Participants must ensure that their submissions are accompanied by the requisite video.
9. The deadline for submitting Entries is 13:00 pm EST, 31 May 2024. An Entry is timely and will be accepted, only if actually received before this time. The time of transmittal will not be taken into account. The SA Future Trust reserves the right to extend the deadline.
10. It is your responsibility to ensure that your entry is received by us prior to the closure of the competition.
11. Any entries which are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry.
12. We and our affiliates are not responsible for any entries which are not received by us, whether timeously or at all, regardless of the cause thereof.
13. Without limitation, we and our affiliates are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, web site or other device or medium), or any combination thereof, or any other technical or other problems.
14. Participants must possess whatever documents and permissions that may be required in order to accept and use a prize, including those from, the Companies and Intellectual Property Commission, South African Revenue Services and/or the Department of Labour, a valid ID document and all necessary documentation, which documents and permissions it is your responsibility to obtain at your own cost, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities.
Personal information
- Participants agree to participate in any reasonable publicity activities related to the competition, such as providing a testimonial, photo, or video, without any additional compensation. SAFT may use the winner’s name, image, and feedback for promotional purposes on its website, social media, or other channels.
- SAFT respects your privacy and will process your personal information in accordance with the Protection of Personal Information Act 4 of 2013. SAFT will only collect, use, and disclose your personal information for the purposes of administering the competition, delivering the prize, and marketing its products and services to you, to which you consent by entering the Competition. SAFT will not share your personal information with any third parties, except as required by law or to fulfil its obligations under these terms and conditions. You have the right to access, correct, or delete your personal information, or withdraw your consent, by contacting the SAFT’s Information Officer at info@southafricanfuturetrust.org For more information, please refer to SAFT’s Privacy Policy on its website.
- SAFT may publish names of the participants and winners on any of our communication platforms. By entering the Competition, the Participant grants permission to the South African Future Trust to use all material presented to promote the SAFT and its activities without confidentiality limitations. The Participant further agrees to provide access to his / her business premises, operations and or staff members as may be required for media and marketing purposes.
- We and our affiliates are not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter or obtain any materials related to the competition.
- It is your responsibility to ensure that any information which you provide to us is accurate, complete and up to date.
Personal information
- Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account. The South African Future Trust will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your entry into the competition and your acceptance and/or use of a prize.
- We do not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and give no warranty that your entry or participation in the competition will necessarily result in you winning a prize.
- We make no representations or give any warranties that any prize will be satisfactory, punctual, free from defects, safe or reliable.
- We and our affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.
- Prizes are not transferable and may not be deferred, changed or exchanged for cash or any other item.
- You may not win a prize if it is unlawful for us to supply such a prize to you. If you do win such a prize, you will forfeit it.
- The winners will be announced at the Awards dinner to be held in November 2024, or such later date as the organizers decide at its sole discretion. The Participant must be present to collect the prize.
- We may require you to provide us with such additional information and documentation as we may reasonably require processing, confirming and facilitating your acceptance and/or use of a prize. If you refuse to provide us with the requested information or documentation, you will forfeit the prize.
- All correspondence regarding the prize must be directed at the supplier of the prize. The South African Future Trust will not be responsible for any further correspondence, harm, damage, loss or claim relating to the provision of any element of the prize.
- We and our third-party suppliers, as the case may be, reserve the right to vary, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which we deem necessary. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests, and expectations that you may have in terms of this competition and acknowledge that you will have no recourse against us, our affiliates and third-party suppliers.
- You agree that your participation in the competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk.
- We and our affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by us or any of our affiliates in accordance with the terms and conditions.
- In the event of your death, your family, dependents, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you, or your partner (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any injury, loss, liability, expense and/or damage which you may suffer, howsoever arising, in relation to your entry into this competition and/or acceptance and/or use by you of a prize
- You acknowledge that the acceptance and use of a prize is subject to the proviso that all of the terms and conditions will apply to both you and your business (if applicable).
- If you fail or, if your partner (if applicable) fails, to comply with any of the terms and conditions, then without prejudice to any other remedy which we may have. You will be automatically disqualified, and you will forfeit the prize/s (in the event, that you have already won a prize):
- You will pay us for any loss or damage incurred by us directly or indirectly as a result of your (or, if applicable, your partner’s) noncompliance, including all our legal costs (including attorney and own client costs) which we may incur in taking any steps pursuant to your (or your partner’s) non-compliance; and
- You indemnify and hold us and our affiliates harmless against any claim by any person, (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any death, injury, loss and/or damage which may be suffered howsoever arising in relation to your failure (or that of your partner, if applicable) to comply therewith.
- For purposes hereof, “affiliate” means our partners, co-promoters and sponsors of this competition, our subsidiaries, our and their subsidiaries and respective holding companies, the subsidiaries of their holding companies, and our and their directors, officers, employees, agents, and representatives.
- These terms and conditions will be construed, interpreted and enforced in accordance with the laws of contract and dispute resolution in the Republic of South Africa.
- The South African Future Trust and the judges’ decision on any matter concerning the competition and/or arising out of these terms and conditions is final and binding on you, and no correspondence will be entered into.
Permissions and Releases
By submitting an Entry, Participants certify they own or have obtained the necessary permission for any images, charts, statistics, or any other information or material used and submitted to the South Africa Future Trust. Any violation may result in disqualification of the Entry. Participants are responsible for protecting their proprietary and other rights under applicable laws.
